NY-22 Brindisi Tenney race: Oneida County affidavit ballot corrections begin Wednesday

By Friday, the Oneida County Board of Elections will complete another round of corrections to its canvass of affidavit ballots in the race for New York’s 22nd Congressional District. 

The corrections originally were scheduled to be completed by Wednesday in the order from state Supreme Court Justice Scott DelConte on Jan. 20. DelConte granted the extension Monday at the request of Assistant County Attorney Robert Pronteau.

DelConte ordered the board of elections to canvass the ballots after it was discovered that 2,418 online voter registration applications, submitted by the state deadline, were not processed prior to Election Day. More than 1,000 affidavit ballots will be canvassed, using available records to determine registration status.

Republican Claudia Tenney leads Democrat Anthony Brindisi by 29 votes in the preliminary, unofficial results of a rematch of the 2018 election, which Brindisi won by less than 4,500 votes.

The canvass will begin at 9 a.m. Wednesday at the Mohawk Valley Community College, as the county board of elections offices “do not provide a Covid-safe space to conduct a canvass,” Pronteau said in his letter. The canvass will run until 6 p.m.; the schedule repeats Thursday and Friday.

Brindisi’s legal team attempted to limit the canvass to 69 ballots challenged by the campaign, filing an appeal in the state Supreme Court’s Appellate Division. An attempt to stay the canvass was denied by state appellate division Justice Patrick NeMoyer in an order Monday. 

DelConte said he intends to file his final ruling on the fate of approximately 1,100 ballots contested by the campaigns before the end of this week.
